Terms of Service

1. The service

Eventyca is a SaaS platform for independent and mid-size event promoters, providing tools for event management, artist booking, financial tracking, audience management, and email campaigns.

2. Your account

• You must be 18 or older to create an account.
• You are responsible for keeping your login credentials secure.
• One account per person. You may invite team members under your organisation.
• You are responsible for all activity under your account.

3. Acceptable use

You agree not to:

• Use Eventyca for any unlawful purpose
• Send spam or unsolicited marketing emails to people who have not consented
• Upload data you do not have the right to use
• Attempt to access other users' data
• Reverse engineer or copy the platform
• Use the platform to harass, defame, or harm others

4. Your data

You retain ownership of all data you upload to Eventyca. You grant us a limited licence to store, process, and display your data solely for the purpose of providing the service. If you delete your account, your data is deleted within 30 days (except where retention is required by law).

5. Audience data and GDPR

If you upload or collect personal data about third parties, you are the data controller and we are the data processor. You confirm that:

• You have a lawful basis for processing this data
• You have obtained appropriate consent where required
• You will honour data subject rights (access, erasure, portability)

6. Email campaigns

You agree to:

• Only send to people who have consented to receive marketing emails from you
• Include a functioning unsubscribe mechanism in every campaign (provided automatically)
• Comply with applicable anti-spam laws (GDPR, CAN-SPAM, CASL as applicable)

7. Subscription and billing

• Plans: Starter, Pro, Agency. A 7-day free trial is available, no credit card required.
• Subscriptions renew automatically unless cancelled.
• Upgrades take effect immediately with prorated billing.
• Refunds are not provided for partial billing periods.
• Payments are processed by Stripe.

8. Service availability

We aim for 99.9% uptime but do not guarantee uninterrupted service. We are not liable for losses caused by service downtime.

9. Limitation of liability

• Eventyca is provided “as is” without warranties of any kind
• We are not liable for indirect, incidental, or consequential damages
• Our total liability to you in any 12-month period is limited to the fees you paid us in that period

10. Termination

You may cancel your account at any time from Settings → Billing. We may terminate your account immediately if you breach these Terms. On termination, your data is deleted within 30 days.

11. Changes to these Terms

We will notify you by email at least 14 days before making material changes.

12. Governing law

These Terms are governed by the laws of the Republic of Croatia. Disputes shall be subject to the jurisdiction of the competent courts of the Republic of Croatia.
